A BILL to amend and reenact section one, article six, chapter
sixty-four of the code of West Virginia, one thousand nine
hundred thirty-one, as amended, relating to authorizing the
fire commission to promulgate a legislative rule relating to
the state building code.
Be it enacted by the Legislature of West Virginia:

That section one, article six, chapter sixty-four of the code
of West Virginia, one thousand nine hundred thirty-one, as amended,
be amended and reenacted to read as follows:
ARTICLE 6. AUTHORIZATION FOR DEPARTMENT OF MILITARY AFFAIRS AND



PUBLIC SAFETY TO PROMULGATE LEGISLATIVE RULES.
§64-6-1. Fire commission.

(a) The legislative rule filed in the state register on the
twenty-third day of July, two thousand one, under the authority of
section five, article three, chapter twenty-nine of this code, modified by the fire commission to meet the objections of the
legislative rule-making review committee and refiled in the state
register on the fourth day of October, two thousand one, relating
to the fire commission (state fire code, 87 CSR 1), is authorized
with the following amendment:

On page one, by striking out section 2.2 in its entirety.

(b) The legislative rule filed in the state register on the
nineteenth day of July, two thousand two, authorized under the
authority of section five-b, article three, chapter twenty-nine, of
this code, modified by the fire commission to meet the objections
of the legislative rule-making review committee and refiled in the
state register on the fifteenth day of January, two thousand three,
relating to the fire commission (state building code, 87 CSR 4), is
authorized.

NOTE: The purpose of this bill is to authorize the Fire
Commission to promulgate a legislative rule relating to the State
Building Code.
